Summary

Seminar Goals and Outcomes

1. Define the terms “civility” and “incivility” as they apply to theProfession of Law and Alternative Dispute Resolution, particularly Mediation.

2. Highlight the various professional standards of civility for attorneys and attorney-mediators, including the key aspects of civility in the California Legal Profession.

3. What does the research say about the practice of civility in Alternative Dispute Resolution (ADR) and mediation? What is the impact of civility on resolving disputes?

4. Make the most of civility and utilize it as a tool to resolve disputes and break impasse: settlement tips for mediators and counsel, research on influence and persuasion, and “tactical empathy” for breaking impasse.

5. Review and examine The Model Standards of Conduct for Mediators (2005) as it overlaps with and enhances the principles of civility in mediation.
